Welcome to PDV Soft, developed and operated by Alves Protect, CNPJ 63.994.803/0001-29, a company established in Brazil (“Alves Protect”, “we”, “us”). These terms apply to businesses established in the United Kingdom that use PDV Soft (the “Customer”, “you”). By creating an account or using the system, you agree to them. PDV Soft is supplied for business use only and is not offered to consumers.

1. The service

Alves Protect grants you a non-exclusive, non-transferable and non-sublicensable right to use PDV Soft (point of sale, stock, online catalogue and related tools), supplied as a service. The system is accessed over the internet with a login and password, with no installation on local servers — you licence access to the service, you do not acquire a copy of the software.

2. Our obligations

• Provide the service and security measures described in the accepted offer. Any specific service-level commitment must be expressly agreed in the contract.
• Maintain backup and recovery procedures; recovery and retention depend on the applicable operational cycle.
• Provide support through the official contact channels, under the conditions of the accepted offer.
• Provide system updates with new features and security fixes at no additional cost.

3. Your obligations

• Use the system only for the lawful purposes of your business.
• Keep your access credentials (login and password) strictly confidential. You are responsible for access resulting from your own negligence.
• Provide compatible equipment (computers, tablets, printers, broadband internet) for the cloud POS to work properly.
• Comply with the laws that apply to your business, including consumer protection, pricing, VAT and e-commerce rules for the sales you make through the system and your online catalogue. You are the seller to your own customers; Alves Protect is not a party to those sales.

4. Fees, payment and suspension

Use of the system depends on timely payment of the subscription fee for your plan, in the amount and currency agreed with Alves Protect. Fees are exclusive of any taxes you are required to account for.

• If payment is not confirmed after the due date, access to the system may be suspended under the accepted plan and applicable notices. Data protection requests remain available even when access is restricted.
• Suspension blocks access to the system but does not delete your data. Access is restored once the outstanding amount has been paid in full.
• Cancellation, refunds and any minimum term are governed by the offer actually accepted and applicable law; these terms do not create an automatic cancellation penalty.
• You may cancel at any time; cancellation takes effect at the end of the period already paid.

5. Intellectual property

PDV Soft and its source code, layouts, databases and operating logic are the exclusive property of Alves Protect and are protected by copyright and other intellectual property laws. Any attempt at reverse engineering, copying or unauthorised extraction is strictly prohibited, except to the extent the law expressly allows it.

6. Data protection (UK GDPR)

For the personal data of your customers and staff that you enter into PDV Soft, you are the controller and Alves Protect acts as your processor, under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. As processor, Alves Protect will:

• process personal data only on your documented instructions and only to provide the service;
• ensure that the people authorised to process the data are bound by confidentiality;
• apply appropriate technical and organisational security measures;
• use sub-processors (such as hosting and email delivery providers) only under written terms that give the data the same level of protection;
• help you respond to requests from individuals exercising their data protection rights;
• notify you of any personal data breach affecting your data without undue delay in accordance with the applicable data protection requirements, so that you can meet your own duty to report to the Information Commissioner’s Office (ICO) within 72 hours where required;
• delete or return your data at the end of the service, at your choice, unless the law requires it to be kept;
• make available the information needed to demonstrate compliance with these obligations.

Your data may be stored and processed outside the United Kingdom, including in Brazil. Where the law requires it, such transfers are made with the safeguards recognised under UK data protection law.

7. Limitation of liability

Alves Protect is not liable for loss of profits, indirect or consequential losses, or problems caused by failures in the internet connection at your premises, defects in your own hardware, or operational mistakes made by your staff. Our total liability under these terms in any 12-month period is limited to the fees you paid in that period. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

8. Governing law and jurisdiction

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.

9. Account closure and erasure requests

Use Settings → Encerramento e exclusão or the user menu to submit and track a request with your password and a reference number. Only a store administrator can request closure of the store. Submission records a request for review; it does not automatically delete records or cancel billing. The response will identify the effective date and any lawful retention. Contact support@alvesprotect.com if you cannot sign in. Personal data rights are not conditional on paying outstanding fees. See the Privacy Policy (Brazilian version). Payment providers process the full card number and CVV on their own page; PDV Soft does not receive or store those fields.
